Expungement of Arrest

If your case is dismissed, you are found not guilty, or nolle prossed, you may file for an expungement to have the charge removed from your arrest record after 10 days.

If you had a deferred adjudication, you must wait until after the case was dismissed by the Court (usually 6 months to a year after your initial court date).

If you are found guilty and there are no further arrests or convictions in a three year period, you may be eligible for an expungement of your record, based on the charge. Convictions of DUI, DUS and Criminal Domestic Violence prior to January 1, 2004 are not eligible for expungement.

INSTRUCTIONS FOR EXPUNGEMENT:

You must fill out the information in the instruction packet which can be picked up from the Clerk of Court, 100 Ribaut Road, Beaufort, SC and contact Judy Rutland at the Solicitor’s Office 1-803-943-3580.
